2. Service Agreement

Upon agreeing to our services, a detailed Service Agreement will be provided outlining the specific tasks, timelines, and costs associated with your landscaping project. This agreement must be signed by both parties before work commences.

2.1. Project Timeline

We strive to complete all projects within the agreed timeframe. However, unforeseen circumstances such as adverse weather conditions may cause delays. We will communicate any changes to the schedule promptly.

2.2. Modifications to Services

Any modifications to the initial Service Agreement must be requested in writing and agreed upon by both parties. Additional charges may apply for changes that increase the scope of the project.

3. Payment Terms

Payments for our services are structured as follows:

Deposit: A non-refundable deposit is required to schedule your project.
Progress Payments: Depending on the project size, progress payments may be scheduled at various stages of completion.
Final Payment: The remaining balance is due upon completion of the project.

We accept various payment methods, including bank transfer, credit/debit cards, and other mutually agreed upon methods.

4. Cancellations and Refunds

We understand that plans can change. To cancel a service:

Notice: Please provide at least 48 hours' notice prior to the scheduled service.
Fees: A cancellation fee may apply, especially if significant resources have been allocated to your project.

Refunds for any deposits or payments will be handled according to the terms outlined in the Service Agreement.

5. Responsibilities and Obligations

5.1. Client Responsibilities

Clients are expected to:

Provide accurate information regarding the scope and nature of the project.
Ensure that access to the property is available during scheduled service times.
Inform us of any potential hazards or restrictions on the property.

5.2. Landscapers Lewisham Responsibilities

We commit to:

Deliver services with professionalism and due care.
Use quality materials and comply with industry standards.
Communicate effectively regarding project progress and any issues that arise.

6. Liability and Insurance

Landscapers Lewisham holds comprehensive liability insurance to cover any accidental damage during our services. However, we are not liable for:

Pre-existing conditions or hidden defects on the property.
Damage caused by acts of nature or third parties.
Misuse of materials or services after project completion.

Clients are encouraged to review their own insurance policies to cover personal property and third-party liabilities.

7. Warranties and Guarantees

We offer warranties on specific services and materials provided. These warranties are detailed in the Service Agreement and cover:

Workmanship defects
Material faults
Plant survival guarantees, where applicable

Warranties are subject to conditions and limitations as specified in the agreement.

8. Dispute Resolution

In the event of a dispute, both parties agree to attempt to resolve the issue through informal negotiations. If a resolution cannot be reached, the matter will be escalated to mediation before seeking legal remedies.

9. Privacy Policy

We respect your privacy and are committed to protecting your personal information. Any data collected during our engagement will be used solely for the purposes of providing and improving our services. We will not share or sell your information to third parties without your consent, except as required by law.

10. Intellectual Property

All designs, plans, and other intellectual property created by Landscapers Lewisham are the exclusive property of the company unless otherwise agreed upon in writing. Clients are granted a limited license to use these materials for personal purposes only.

11. Termination

Either party may terminate the Service Agreement under the following conditions:

Material Breach: Failure to comply with the terms outlined in the agreement.
Mutual Agreement: Both parties agree to terminate the contract.
Force Majeure: Events beyond the control of either party that make it impossible to continue the project.

Upon termination, any outstanding payments for services rendered up to the termination date are due immediately.

12. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. Any legal actions arising from the use of our services shall be subject to the exclusive jurisdiction of the courts in this region.

13. Amendments

Landscapers Lewisham reserves the right to amend these Terms and Conditions at any time. Clients will be notified of any significant changes, and continued use of our services constitutes acceptance of the updated terms.

14. Severability

15. Entire Agreement

These Terms and Conditions, along with the Service Agreement, constitute the entire agreement between the client and Landscapers Lewisham. They supersede all prior agreements, understandings, and representations regarding the services provided.
